The Primorsky Regional Court sentenced a Sakhalin fisherman in absentia Oleg Kan to 17 years in a maximum security colony on charges of organizing the murder of a businessman in Vladivostok in 2010, a RIA Novosti correspondent reports from the courtroom. […]

The prosecution, led by Deputy Prosecutor General Dmitry Demeshin, insisted on a sentence of 19 years in a maximum security colony.

The businessman was also given an additional punishment in the form of restriction of freedom for 1 year with the imposition of certain duties and restrictions. The period of departure will be calculated from the moment of actual detention of Kahn.

In addition, the court ordered compensation for moral damages from Kan in favor of five victims in the amount of 3 million rubles each, for a total of 15 million rubles.

Kahn’s defense declared his innocence and promised to appeal the verdict.

The Prosecutor General’s Office in October approved an indictment against Kan, whom the media called “crab king”. According to investigators, in 2010, Kan organized the murder of businessman Valery Phidenko, who, as he believed, was involved in the attempt on his life.

In August-October of the same year, Kan found the perpetrator of the murder, whom the investigation had not yet been able to find, as well as an accomplice, local resident Dmitry Polyakov. The latter invited Phidenko, under the pretext of business negotiations, to Vladivostok and provided him with a telephone number, the number of which he gave to the organizer of the murder. When the businessman arrived at the Three Bogatyrya restaurant, the killer killed him with three shots.

Kan hid from investigation abroad, was put on the international wanted list, and was given a preventive measure in absentia in the form of detention. Polyakov was sentenced to seven years in prison in 2011.

The second criminal case against Kan on the creation and leadership of a criminal community, smuggling of strategically important resources, evasion of customs duties and taxes was sent from Vladivostok to the court of Yuzhno-Sakhalinsk. According to investigators, he and his accomplices were involved in crab smuggling abroad from 2014 to 2019. In total, more than 3 thousand tons worth 2.6 billion rubles were exported. During export, the goods were declared at one price, but in reality they were shipped at an inflated price.

In addition, according to the investigation, Kan, being the actual owner and leader of a group of five Russian enterprises, using a scheme of dividing a single large business into formally autonomous organizations, evaded paying taxes on profits and value added by more than 3.6 billion rubles.

The prosecutor’s office also filed a lawsuit against recovery from Kan criminal income of 4.2 billion rubles in favor of the state. The property of the leader and members of the criminal community, as well as legal entities, worth more than 5.3 billion rubles, was seized. The damage to the state was eventually fully compensated.

In the FNP electronic database, an inheritance case has been opened regarding the death of a person whose full name and date of birth coincide with businessman Oleg Kan; according to it, he died on February 14, 2023. Lawyer Oleg Sukhanov provided a death certificate from the UK as confirmation of the fact of death.

The Prosecutor General’s Office called the data on the businessman’s death a staged act, since the registry office does not have such information, and Kan’s relatives did not contact the registry office. — Insertion K.ru
